REMINDER: New Consent Requirements for Telephone Calls and Text Messages Effective October 16

Attached please find an important reminder about the new FCC consent requirements for phone calls and text messages that go into effect on October 16, 2013. Dealers should review the rules and work with their counsel and any third party vendors to ensure that all phone calls and text messages they make or send (or that are made or sent on their behalf) meet these new requirements. OHIO MINIMUM WAGE SET TO INCREASE ON JANUARY 1, 2014

Ohio’s minimum wage is scheduled to increase on January 1, 2014 to $7.95 per hour for nontipped employees and to $3.98 per hour for tipped employees, plus tips. The increased minimum wage will apply to employees of businesses with annual gross receipts of more than $292,000 per year. The current 2013 Ohio minimum wage is $7.85 per hour for non-tipped employees and $3.93 for tipped employees, plus tips. The 2013 Ohio minimum wage applies to employees of businesses with annual gross receipts of more than $288,000 per year. Read More

Strike Two – The EEOC’s Failed Attempts To Limit Background Checks

On August 9, 2013, the EEOC suffered its second defeat of the year in litigation involving employer use of criminal and credit background checks for employment screening. A federal district court in Maryland held that the EEOC’s expert analysis was statistically flawed, unreliable, and insufficient to demonstrate disparate impact. EEOC v. Freeman. The district court characterized the EEOC’s lawsuit as a “theory in search of facts to support it,” and held that “[s]omething more, far more, than what is relied upon by the EEOC in this case must be utilized to justify a disparate impact claim based upon criminal history and credit checks.” Read More
